Use Of Personal Finance for Military Life’s Website and Materials

The purpose of the Personal Finance for Military Life (“PFML”) website is to provide information and resources to help improve financial readiness for military service members and their families. The PFML website and related materials (the “Site”) have been prepared for informational purposes only. The Site is owned and managed by the USAA Educational Foundation (the “Foundation”, “we”, or “our”). By utilizing the site, you agree to the following terms and conditions (“Site Terms”).

Not Legal or Professional Advice

PFML and the Foundation do not endorse or promote any commercial supplier, product or service. Information on the Site is not to be construed as medical, legal, tax or investment advice. The Site constitutes only a general overview of the subject matter discussed. PFML and the Foundation do not provide professional services for financial, accounting or legal matters. You should always consult with your tax and legal advisers regarding the legal consequences of your financial planning or other activities. It is your responsibility to evaluate the accuracy, completeness and usefulness of any opinions, guidance, services or other information on the site as they may pertain to your specific situation. We are not responsible for any errors, failures, or malfunctions of your computer or software. You are responsible for ensuring that your computer and software are compatible with our Site. We reserve the right to change the system requirements for using this Site.

Intellectual Property

All materials, information, images, graphics and text on the Site are owned by the Foundation and protected by copyright laws. No part of this Site or the materials contained thereon may be copied, reprinted, reproduced, modified or distributed without the express written consent of PFML and the Foundation. All other rights are reserved. The names, trademarks, service marks and logos appearing on this site may not be used, including within any advertising, publicity, or otherwise to indicate PFML’s or the Foundation’s sponsorship of or affiliation with any product or service, without the prior express written permission of PFML and the Foundation.

Unless otherwise stated, PFML and the Foundation do not accept unsolicited ideas, suggestions, or materials relating to development, design, or marketing of any services and products available through the Site. Any such postings to this Site and electronic mail delivered to PFML or the Foundation will be considered non-confidential and non-proprietary, and will remain, the exclusive property of PFML and the Foundation. PFML and the Foundation may copy, disclose, distribute, incorporate, and otherwise use the item and any information contained therein for any purpose without compensation.

Prohibited Uses

Personal Use Only: You will use the Site only for your personal, noncommercial use unless you and PFML and the Foundation have agreed otherwise in writing.

Electronic Mail: You may not send electronic mail to us that is illegal, obscene, profane, threatening, defamatory, invasive of privacy, infringing of intellectual property rights; or contains harmful code, political campaigning, commercial solicitation, chain letters, or mass mailings; or violates any applicable law, such as the CANSPAM Act.

Access: You may not use this Site in any manner that could damage or overburden any PFML or Foundation equipment or software. You may not use any means of systematic retrieval of data or other content from this Site. You may not obtain, or attempt to obtain, access to any material or information on this Site that is protected by passwords, PIN or required login identification through any means not expressly authorized by PFML and the Foundation. You may not use the login information of another person, unless they specifically authorized you to do so.

False Information: You may not intentionally provide any false information when you use this Site, including when ordering any products or services through the Site.

Framing: You may not frame any Site content.

Links: You agree to obtain our permission before creating a hyperlink or similar link or connection to this Site.

Endorsements: You may not use PFML’s or the Foundation’s name or trademarks in any way that implies affiliation with, or an endorsement, sponsorship or approval by PFML or the Foundation without the express written permission of PFML and the Foundation.

Modification

PFML and the Foundation shall have the right, at its discretion, to change, modify, add or remove terms of these Site Terms or the Site at any time. Changes shall be effective immediately, and your subsequent use of the Site shall constitute acceptance of them.

Miscellaneous

Governing Law: Use of this Site and the Site Terms shall be governed by and construed in accordance with the laws of the State of Texas without giving effect to any principles of conflicts of laws. The Uniform Computer Information Transactions Act or any substantially similar law, if enacted, will not govern any aspect of these Site Terms or your access to this Site.

Jurisdiction and Venue: Exclusive jurisdiction and venue for any claim or dispute under these Site Terms shall be with a court of competent jurisdiction in Bexar County, Texas. You consent to the jurisdiction of such courts and agree to accept service of process issued by such courts.

Severability: If any provision of these Site Terms is unlawful, void or unenforceable, the remaining provisions shall remain valid and in effect to the fullest extent possible.

Waivers: Any waiver of any provision of these Site Terms will be effective only if in writing and signed by an authorized representative of PFML and the Foundation. Any delay or omission by PFML or the Foundation to exercise any rights under these Site Terms shall not be construed to waive any rights.

Section Headings: The section titles, the italicized explanations in the shaded boxes, and the section headings are for general reference purposes and shall not to be used in interpreting the terms of the Site Terms.

Survival: Certain provisions of these Site Terms by their nature shall continue in full force and effect after termination, including those related to authorizations you have granted, disclaimer of warranties, limitation of liability, governing law, jurisdiction and venue, and enforceability.
